TERMS AND CONDITIONS

Please read the Terms and Conditions carefully and in their entirety before completing your purchase of the HA RECOVERY HUB membership. These Terms and Conditions ("Terms") govern the use of the membership material and then provision of dietetic services by Ellen Kelly and EK Nutrition Ltd (“Dietitian" or "Service Provider”) to clients in the HA Recovery Hub (“the membership”). By purchasing the membership, you ("Client" or "User") agree to abide by these Terms.

Client Responsibility:

You understand that you must be at least 18 years old to purchase this membership. By purchasing, you confirm that you meet this age requirement.
You understand that this membership is not a substitute for medical advice. By engaging in these services, you understand that Ellen Kelly is a HCPC Registered Dietitian and SENR Registered Sports Dietitian. Ellen Kelly and EK Nutrition Ltd. are not medical doctors, psychologists/psychiatrists, or other licensed medical professionals. By purchasing, you acknowledge that Ellen Kelly is not your personal dietitian and cannot give you bespoke advice.
The community space provided as part of the membership is for peer support only and does not replace professional medical guidance.
You understand that this membership is not suitable if you have an active eating disorder or are seeking support for an eating disorder. By purchasing, you confirm that you do not have an active eating disorder.

Community Guidelines:

As a member of the HA Recovery Hub (“the membership”), you will be part of a community space where names and personal details may be shared. By purchasing the membership, you agree to not share any information that you become privy to outside of the community.
By joining the membership, you agree to be mindful of potentially sensitive topics such as weight gain and exercise goals before sharing posts. You understand that these will be moderated and unhelpful posts will be removed. Repeated incidents of unhelpful or triggering content may result in a temporary or permanent ban from the community.

Payment and Cancellation policy:

You understand that this is a monthly subscription based service that you can cancel at any point. The monthly fee is £39.99 per month.
The Dietitian and EK Nutrition LTD reserve the right to remove user access to the membership in the event that payment is not made.

Intellectual Property and User Conduct:

All content provided as part of the membership, including but not limited to text, graphics, logos, images, videos, downloadable resources and recommendations, is the intellectual property of Ellen Kelly and EK Nutrition LTD. or its licensors and is protected by copyright.
You will not copy, reproduce, distribute, or create derivative works from the membership content.
We grant you a non-exclusive, non-transferable, revocable license to access and use the membership material for your personal, non-commercial use. You may not distribute, modify, transmit, reuse, download, or use the membership content for public or commercial purposes.
You are not authorised to share the membership content and its downloadable material with any other individual, including other service users. You are not permitted to share your login details with other individuals and your access to the course will be removed should this occur.
You are responsible for ensuring that your device meets the necessary technical requirements to access the membership content.
We strive to ensure that the membership material is available at all times. However, we do not guarantee uninterrupted access and may temporarily suspend the membership access for maintenance, upgrades, or other reasons which may be out of our control.

Refund and Cancellation Policy:

Due to the downloadable and instant-access nature of the resources and videos within the membership, refunds are not given.
You understand that you are responsible for the implementation of the recommendations made to you and therefore the outcome of the membership. We do not guarantee any specific results from your use of the membership.
The testimonials relating to the membership are examples of what clients have achieved through working with Ellen Kelly and EK Nutrition LTD and are not guaranteed outcomes of the use of the membership.
You understand that the membership materials are provided virtually. In the event that technological errors arise, EK Nutrition Ltd. will not be held responsible for time lost as a result of technological issues.

 

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of Cyprus. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Cyprus.

Data Collection:

You understand that EK Nutrition Ltd. will collect and process personal information. By registering to the membership, you consent to such processing.

Limitation of Liability:

The Dietitian or EK Nutrition LTD shall not be held responsible for any adverse effects, complications, or injuries resulting from the membership and resources provided.

 
To the fullest extent permitted by law, EK Nutrition Ltd. expressly disclaims liability for any direct, indirect, and/or consequential damages suffered by you related to your purchase or use of, or participation in, the membership, its materials, our website, or any other information obtained by you from us. By purchasing the membership, you hereby agree to this limitation of liability and release Elle Kelly and EK Nutrition Ltd. from any and all claims.

By participating in and/or purchasing the membership, you agree to release, forgive, forever discharge, defend, indemnify, and hold harmless Ellen Kelly and EK Nutrition Ltd., our employees, agents, contractors, subcontractors, shareholders, directors, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, related to, or arising out of, your purchase of or participation in the Programme and/or your breach of any obligation, warranty, covenant, or representation set forth in these Terms of Use.
 

By enrolling in the membership, you agree to release us from any and all claims, and further agree to at all times defend, indemnify, and hold harmless Ellen Kelly and EK Nutrition Ltd. as stated in this section herein.
